Third party matters are claims which involve a third party, e.g. the State.  In South Africa the most notably third-party claims are against the Road Accident Fund (RAF).

Who is the RAF?

    • The RAF is listed as a national public entity in accordance with Schedule 3A of the PFMA.
    • The RAF was established on 1 May 1997.
    • The RAF is funded by the public through a labyrinth of taxes, most notably on a fuel levy.

How to claim: –

    • Make an appointment with us, it is much more complicated than you might think.
      • You must sign a contingency fee agreement and all relevant Power of Attorneys.
    • You are compensated by the Government, not by an Attorney, you will only be paid when a Court approves the claim, and you have a Court Order.
    • Disputed claims can take years to finalise, and again, it is at the Courts discretion and  NOT the Attorneys.
    • Claims are heavily reliant on case law.

    • The value of your claim is awarded by a Court.
    • Unless otherwise specified, all experts’ costs and legal costs are taxed off before payment is made to the client.
