Overview of Criminal Procedure in South Africa

The criminal procedure in South Africa follows a structured legal process governed by the Criminal Procedure Act 51 of 1977. It involves the following key steps:

  1. Reporting a Crime & Police Investigation
  • A criminal case begins when a crime is reported to the South African Police Service (SAPS).
  • The police investigate by collecting evidence, taking witness statements, and possibly making arrests.
  • If there is enough evidence, a docket is prepared and sent to the National Prosecuting Authority (NPA).
  1. Arrest & Bail
  • The suspect may be arrested immediately (if caught in the act) or later (based on evidence).
  • The suspect may:
    • Be released on police bail for minor offenses.
    • Apply for court bail if the offense is serious.
    • Be denied bail if deemed a flight risk or a danger to society.
  1. First Court Appearance
  • The accused appears in a Magistrate’s Court within 48 hours of arrest.
  • The charges are read, and the court decides whether the case should:
    • Proceed to trial.
    • Be postponed for further investigation.
    • Be transferred to a higher court (if it’s a serious offense).
  1. Plea & Pre-Trial Procedures
  • The accused can:
    • Plead guilty, leading to a sentencing hearing.
    • Plead not guilty, leading to a trial.
  • A pre-trial conference may be held to clarify legal issues and ensure the case is ready for trial.
  1. Trial Process
  • The trial takes place in the Magistrate’s Court (for less serious crimes) or the High Court (for serious offenses like murder or rape).
  • The prosecution presents its case, including:
    • Witness testimonies.
    • Physical evidence.
  • The defense can cross-examine witnesses and present counterarguments.
  • After all evidence is heard, both sides present final arguments.
  1. Verdict & Sentencing
  • The judge or magistrate delivers a verdict:
    • Guilty – The court proceeds to sentencing.
    • Not guilty – The accused is acquitted and released.
  • If guilty, sentencing may include:
    • Fines
    • Imprisonment
    • Suspended sentences
    • Community service
  1. Appeals & Reviews
  • The convicted person may apply for an appeal (to challenge the verdict or sentence).
  • A review can be requested if there were procedural irregularities.

 

CRIMINAL LAW

When a person is arrested by the Police or are summoned to appear at Court, the wheels of the criminal justice system is set in motion.

In criminal matters the State acts against an individual found to have transgressed the statutory laws of South Africa, i.e. committed a crime.

The State then has a statutory duty to prosecute an individual which they deem to have broken the law and to have the accused explain or defend his or her actions.

The onus or burden is on the state to proof that that individual did in fact committed the charged crime beyond a reasonable doubt.

  • What should you do when you are summoned or arrested:
    • Respect the Police and, understand that you are not in charge.
    • Provide JUST the essential details, your address, name and identification number, NOTHING MORE.
    • CAVEAT: DON’T ADMIT OR SIGN an admission of guilt if you are innocent. If you sign an admission of guilt, you admitted guilt and shall be fined or imprisoned in accordance with the sentencing provisions of the crime AND you shall have a criminal record.
    • Phone your wife, husband, partner, mother, father, brother or sister, ANY person in your confidence and inform them what happened and where you are.
