CONSULTATIONS

Steps: –

  1. Due to the complexity and risks involved in legal matters, we require formal consultation before commencement of any legal work.
  2. The client must schedule an appointment with this Office and pay our opening fee of R1 500.00 on Trust before or on the day of consultation which shall be deemed confirmation of the appointment.
  3. On confirmation of appointment a file shall be opened, a reference number shall be allocated, and the attorney shall give legal advice on the facts submitted by the client.
  4. All correspondence shall be in writing and failure by a client to reply, confirm or give instructions shall not be tolerated by this Office.
  5. On instruction from the client to, notify, demand from or commence litigation, further costs and processes shall be discussed and agreed to.
  6. Matters are assessed in the complexity, risks and cost of the matter, as explained below.
  • Complexity of a matter
    • The complexity of a matter is assessed in unison with the risks in relation to but not limited to the following factors: –
  • What law/s applies?
  • How many parties are involved?
  • In which jurisdiction is the matter?
  • Are Government Department/s involved?
  • What is the value, monetary of damages, of the claim or loss?
  • Risks
    • Risk assessment
      • Risk assessment is done prior to the commencement of a matter.
      • This is done by, determining what damages a party might suffer if the outcome of a matter is not in his or her favour.
      • Another aspect is the costs factor.  If a person claims R20 000.00 from another party, the risks is that in some cases the legal costs easily exceed the claims.  Then a person must elect whether to pursue the claim or settle the matter.
  • Cost of Litigation
    • Legal fees are mainly comprised of two factors, the risk and the complexity as discussed above, and explained in our legal cost tab.
    • It is advised that you request a cost estimate to assist you in planning for litigation.

How to prepare for a consultation

  • Your preparation in your matter, will save you money.
  • Collect all relevant information, documentation, statements, account etc. prior to the consultation.
  • If you act in capacity as a member of a closed corporation, director of a company, as a trustee, shareholder or whatever office you must obtain the appropriate resolution, proxy or authorisation to act in the matter.  We can assist you in that.
  • Prepare a chronological summary of events.  Dates and amounts are very important in litigation.
